Is Mayor Andy Berke doing a good job so far?

The forks stopped clanking and people turned their chairs for a better view as Chattanooga Mayor Andy Berke stepped up to the podium at the Chattanooga Convention Center on Thursday.

The 45-year-old attorney and former Democratic state senator, who is approaching his 100th day in the mayor's office this week, trotted out a list of his accomplishments to business and community builders at a weekly Rotary Club meeting.

He said he's revamped City Hall, fired 18 department heads and eliminated four departments his predecessor, Ron Littlefield, had created in the previous eight years.

Berke pushed the building's owner to clean up the troubled Patten Towers after a fire left the building's 241 elderly and disabled residents without a place to live, and promised the city's Rotarians that he would fight Chattanooga's gang problem by borrowing from a successful North Carolina anti-drug program.

"We are transforming the culture of government," Berke told the group.

But even as the freshman mayor drew praise from some in the Scenic City, other leaders say they are anxious to see tangible results.

"We had a honeymoon period," said Everlena Holmes, Glenwood block leader coordinator. "By September he needs to have a plan on the ground going."

Berke's ability to listen and hold community meetings has made him popular with many marginalized voters. He said early on that residents ideas, concerns and their participation would be "central to my administration."

But his tenure thus far has been marked by little specific action on any particular issue.

Though Berke took credit for 917 jobs created on his watch, a Times Free Press review found that the genesis of almost all those jobs came under Littlefield.

A Berke pledge to combat violence by 2014 has yet to reduce violence on the streets. Street shootings are up since he disbanded the city's gang task force and replaced it with his own group. Chattanooga was rocked by 71 shootings and 86 deaths in the first half of 2013, compared to 51 shootings and 59 victims for the same period in 2012.

"I don't see anything getting done except more people getting shot," said former Republican Party chairman Marty Van Schaaf.

However, Berke has impressed in other, less headline-grabbing ways.

Perrin Lance, president of Chattanooga Organized for Action, said the mayor is an excellent listener.

Lance applauded Berke for listening to Lincoln Park residents over plans to build a road expansion that would run alongside a historically black park.

Yet it remains to be seen whether Berke will step up and address social and economic problems that extend beyond downtown Chattanooga, Lance said.

"I think Mayor Berke has a challenge that I haven't heard him address," Lance said. "It's the question of equity. We need a mayor that is going to be the mayor of the other Chattanooga."

BERKE'S VIEW

From his seat across a long conference table in City Hall, Berke, wearing a navy blue striped suit and tie, told the Times Free Press on Friday that he's most surprised by how time-consuming being mayor can be.

"Going from a speech to a meeting on economic development to a phone call with the police chief ... demands an ability to clear your mind and focus quickly," he said.

Berke, who ran without any substantial competition, swept 72 percent of the votes to gain the mayor's seat. In his inaugural address and on the campaign trail, Berke promised to focus on youth development, public safety and economic development.

"I believe we have accomplished a tremendous amount in 100 days," he said.

Berke pointed to his public safety committee, which has many members from the former gang task force, including Hamilton County Sheriff Jim Hammond, Hamilton County Mayor Jim Coppinger and District Attorney General Bill Cox.

The committee's main initiative, nicknamed High Point after the city that founded the program, will roll out in 2014. The main focus is to eliminate gang violence through focusing on the major drug dealers, but Berke said the program also includes cease-fire negations and domestic violence programs.

"All these don't happen overnight," he said. "We need to reduce the shootings. Period. And we are going to do that."

He promises the community will see fewer shootings by 2014.

Some former city officials criticized Berke for being so quick to disband the task force, questioning whether it was a waste for the work already done.

"I was disappointed to see him dismantle the gang task force to begin again discussions that had already taken place," said Pam Ladd, former City Council chairwoman.

Other former officials echoed Ladd.

Looking at job growth in the city, Berke said the city will continue to work with the Chamber of Commerce. But his newly created Department of Economic and Community Development will focus on all levels of business, and it will connect job growth directly to the neighborhoods by finding a way to provide public transportation so the community can get to those jobs, he said.

As for how he will do it, Berke declined to be specific.

On his focus on youth development, Berke cited the literacy programs at the recreation centers, where young children are being taught to read.

Yet this initiative began last year under the former gang task force that the mayor disbanded when he took office.

Compared to Littlefield, some community members said they find Berke more approachable.

Lincoln Park Neighborhood Association President Vannice Hughley said that before Berke, neighbors didn't know what was happening on projects that might affect their community until the decision already had been made.

"He's worked step by step, he's been in the trenches with us," Hughley said. "[Before], we were never at the table."

Joyce Watson Careathers, president of the Churchville Neighborhood Association said she, too, admires how Berke has reached out to the local communities.

County officials also say communication is better between the city and county.

Hamilton County school board members Jeffrey Wilson and David Testerman said Berke has expressed interest in the city being involved in the school system.

"He's helped start the discussion of what role can the city of Chattanooga play in helping improve education for our youth," Wilson said.

Littlefield's archenemy Jim Folkner, who led the charge to have the mayor recalled, said he will wait to pass judgment on Berke until after the budget is revealed.

City officials have said they will present the budget to the City Council on July 30.

Stocks slip after record highs; Dow down 33 points

Stocks finished largely unchanged in lackluster trading Friday, with the S&P 500 squeezing out a small gain to finish at another record high, but a batch of disappointing tech earnings weighed down the market.

Despite the limp session, the Dow and S&P still logged their fourth-straight week higher.

The Dow Jones Industrial Average closed 4 points lower, dragged by Microsoft and Hewlett-Packard.

The S&P 500 eked out a gain to close at a record high, while the tech-heavy Nasdaq ended in the red. The CBOE Volatility Index (VIX), widely considered the best gauge of fear in the market, fell below 13.

Among key S&P sectors, techs led the laggards, while health care gained.

Google and Microsoft tumbled after both tech giants disappointed the market after the closing bell Thursday with quarterly earnings and revenue that fell well below Wall Street expectations. At least eight brokerages slashed their price targets on Google, while seven cut their price targets on Microsoft.

Also among techs Advanced Micro Devices tumbled more than 10 percent after the chipmaker said its gross margins would fall, even as the company forecast better-than-expected revenue growth in the third quarter. Analysts were mixed on the stock: at least five brokerages raised their price targets on the company, while Credit Suisse and Morgan Stanley lowered their ratings.

Offsetting the losses in the tech sector, General Electric jumped to lead the Dow gainers after the conglomerate posted earnings that edged past expectations by a penny a share.

So far, one-fifth of S&P 500 companies have reported quarterly results, with 65 percent of companies posting earnings above estimates, while 51 percent missing expectations, according to the latest data from Thomson Reuters. If all remaining companies report earnings in line with forecasts, earnings will be up 2.9 percent from last year's second quarter.

Barry Knapp, head of equity portfolio strategy at Barclays noted that domestically orientated U.S. stocks have outperformed this quarter.

"This quarter, domestic revenues are starting to go up, which makes perfect sense given those stocks have been telling you that for six months. Companies with foreign-derived revenues remain under pressure," he said.

The Dow and the S&P set fresh highs on Thursday, after Federal Reserve Chairman Ben Bernanke reiterated his commitment to easy monetary policy, in his second day of testimony before lawmakers.

"What we do know with more certainty is that in September the Fed is going to slow its asset purchases," said Knapp.

Beyond the U.S., markets will also watch a meeting of G-20 finance ministers in Moscow on Friday and Saturday to see if global policy makers can do anything further to calm recent volatility and boost global growth.

Treasury Secretary Jack Lew will be in attendance. Ahead of the meeting, Lew said the U.S.was once more a "source of strength" in the global economy.

"The U.S. is again a source of strength in the world economy, only five years after it was the center of a global crisis. This has not happened by accident," said Lew in an opinion piece published by the Financial Times. "In many parts of the world, such as Europe, growth is too weak to drive job creation, and it is critical to take steps to bolster private hiring."

Meanwhile, the Nikkei fell from a two-month peak on Friday, as investors unwound long positions in the futures and cash market ahead of upper house elections over the weekend. Other Asian stocks also reversed gains, with the Shanghai Composite easing over 1.5 percent and Australia's S&P ASX 200 index retreating further from the 5,000 mark.

Man sentenced for arson fire at Hacienda Heights church

A judge sentenced man to 18 years to life in prison Friday for lighting an arson fire that destroyed the sanctuary of a Catholic Church in Hacienda Heights on April 16 of 2011.

A Pomona Superior Court jury earlier this month convicted Gregory Yusuke Shiga, 35, of Hacienda Heights of five felony counts related to the arson fire that caused about $9 million in damages at St. John Vianney Church, 1345 Turnbull Canyon Road.

Two priests sleeping in a rectory that also caught fire adjacent to the destroyed sanctuary narrowly escaped from the building, according to prosecutors and investigators.

"I never got the impression from Mr. Shiga that he was remorseful for his actions or their effect on a large community that cared deeply about

that place," said Los Angeles County Deputy District Attorney Renee Rose, who prosecuted the case.

She went on to request Judge Thomas Falls hand down the maximum sentences for the charges under the law, describing Shiga as a continuing threat to the public.

Falls agreed, imposing the maximum sentence of 18 years to life in prison.

Shiga was convicted of aggravated arson, arson of a structure, arson of an inhabited structure, possession of an incendiary device and burglary. The jury also found true special allegations that multiple structures were burned, the fire was likely to cause injury and that an accelerant was used in the arson.

Shiga is eligible to receive 15 percent credit for good behavior while incarcerated for eight years of his prison sentence. However he must serve 10 years in full, without reductions for good behavior, Rose explained. She estimated Shiga will first become eligible for a parole hearing in about 16 years.

Shiga previously underwent a mental evaluation which determined he was fit to stand trial, though officials said Shiga adamantly denied suffering from any form of mental illness, according to Los Angeles Archdiocese Canonical Auditor Marty Gallagher, a former FBI agent who worked alongside church officials and law enforcement officials during the investigation.

Against the judge's advice, Shiga fired his defense attorney and chose to represent himself just before his trial began, officials said. But Falls said Shiga had shown he was aware of what was going on and even complimented him on his courtroom demeanor and knowledge.

When asked by Judge Falls if he had a statement to make prior to receiving his sentence Friday, Shiga responded that he did.

"It's 9:17 a.m. July 19th. That's about it," he said.

Shiga, who was described by investigators as highly intelligent, "is fixated with numbers," Rose said.

Among other tattoos not visible in the courtroom, Shiga had the number seven tattooed on top of his left hand, and the number nine tattooed on top of his right hand.

The significance of the numbers was unclear, other than they appeared to be his favorites, according to an investigator.

Shiga broke into the sanctuary of St. John Vianney Church shortly after midnight on the week before Easter, Yoshino said.

He brought with him a backpack containing eight to ten rolls of toilet paper that had been soaked in flammable liquid, he said. The specific substance or substances used were not available.

He placed the fuel-soaked toilet paper rolls as "strategic" locations within the sanctuary, Yoshino said.

He opened up every other window in the sanctuary to help the fire spread faster, Rose said.

Using a sprayer similar to the type used for spraying weeds, Shiga then sprayed the ceiling and walls of the church with flammable liquid before using a tiki torch to set the structure ablaze, Rose said. The sanctuary was quickly engulfed with flames, which also spread to the occupied rectory next door where two priests were sleeping upstairs.

Following his arrest more than a year after the fire, Rose said investigators found Shiga had visited and photographed the church before the arson fire.

A break in the case came when a former school teacher of Shiga's came forward to report a suspicious encounter with Shiga prior to the arson, Rose said.

Barbara Clark taught Shiga about 20 years ago when he attended St. Mark's Lutheran School in Hacienda Heights, according to the prosecutor.

Her former pupil arrived at the campus about two weeks prior to the arson, where Clark was principal, Rose said. He spoke to her and asked many questions about St. John Vianney Church and the symbolism behind its statues and other items.

"It didn't mean much to her at the time," Rose said. But following the massive fire, Clark decided to report the encounter to authorities.

Witnesses shown photographic line-ups including Shiga then identified him as the arsonist, she said. He was arrested May 14, 2012.

Beyond a general grievance against the Catholic Church, of which Shiga was never a member, a definitive motive was not revealed through the trial, according to Sgt. Derek Yoshino of the Los Angeles County Sheriff's Arson-Explosives Detail. Sheriff's investigators, along with FBI agents, investigated the case.

"He indicated he wanted to make a statement against the Catholic Church," Yoshino said. But the arsonist never elaborated.

"It was pretty general," the sergeant said. "At this point, we're left to assume what his actual motive was."

Rose said while Shiga may have claimed to have complaints regarding the church in an attempt to justify the crimes, it was always about Shiga himself.

"I think he did it for the attention," Rose said. Even as he waited to be sentenced to prison, Shiga seemed to enjoy being the focus of attention. He appeared pleased to see reporters in the courtroom.

Sentencings normally are not carried out so quickly following a trial, Falls said. "The defendant requested a speedy sentencing."

In addition to sentencing Shiga to prison, Falls ordered him to pay the church $8.9 million in restitution, though he acknowledged the convict would likely never be able to pay it.

St. John Vianney Church Rev. Msgr. Tim Nichols accepted the amount on behalf of the church.

Gallagher thanked the sheriff's, FBI and district attorney's office officials for their hard work in the case.

"Thank God there were no deaths," he said. It's a tragic event. It could have been horrendous."

After BlackBerry's disastrous earnings a couple of weeks back, Nokia and Microsoft have clear bragging rights over third place in the ecosystem war -- but does a bronze medal earn you any cash? The Finnish manufacturer has reported declining Q2 2013 revenues of €5.69 billion ($7.4 billion) compared to the $9.2 billion earned in the same quarter last year. The good news is that the huge financial losses of 2012 seem to be gone, with today's reported loss standing at just €115 million ($150 million), all of which can be laid at the feet of Nokia's devices and services division.

Meanwhile, the company's smartphone sales seem to be growing thanks to fresh Lumia models like the 520, 620 and 720 -- with a total of 7.4 million Windows Phone 8 devices sold in the quarter. For context, that's significantly more than the 6.8 million units BlackBerry could boast in its latest report. It's also a big improvement on the 5.6 million in Lumia sales from Q1 and the 4.4 million sold in Q4 2012. However, the Asha division saw sales slip down from 5 million last quarter to 4.3 million now. Oh, and if anyone's still in the market for a Symbian handset, better be quick -- the company is reporting that sales of the phones are now "approximately zero."

In other parts of the business, "Here," Nokia's renamed mapping division, lost €89 million ($116 million) while Nokia Siemens Networks made a slender €8 million ($10.4 million) profit. Looking forward, the company has said that it's lowering its future estimates by two percent, saying that dwindling demand, higher operating expenses and "the macroeconomic environment" will all help to erode the company's cash reserves. But hey, at least Microsoft's still kicking in that $250 million in alimony platform support payments.

IRS watchdog 'disturbed' agency withheld documents

WASHINGTON (AP) ? The investigator who wrote a scathing report about the Internal Revenue Service targeting tea party groups says he is "disturbed" the agency withheld newly released documents showing progressive groups may also have been singled out for additional scrutiny.

IRS Inspector General J. Russell George told a congressional panel Thursday the IRS did not provide the documents to his office during a yearlong audit. George said he just received the documents last week.

George issued a report in May that said IRS agents in a Cincinnati office improperly singled out groups with "tea party" and other conservative labels for additional scrutiny when they applied for tax-exempt status during the 2010 and 2012 elections.

George's report blamed ineffective management for allowing the practice to continue for more than 18 months, delaying hundreds of applications for more than a year.

Since the revelations were made public, three congressional committees and the Justice Department launched investigations and much of the top leadership was replaced, including the acting commissioner.

"The reason the report focuses on the terms 'tea party,' 'patriots' and '9/12' is that the IRS provided us a document at the beginning of our audit that shows these were the terms they used to select the potential political cases," George told the House Oversight and Government Reform Committee.

Last month, the IRS provided documents to Congress that suggested some liberal and progressive groups may have been singled out for additional scrutiny as well ? information that was not included in George's May report. Some Democratic lawmakers said this was proof that George's report was one-sided.

"The committee has obtained new documents that raise serious questions about the inspector general's report, his testimony before Congress and his subsequent assertions in letters to members of Congress," said Rep. Elijah Cummings of Maryland, the ranking Democrat on the oversight committee.

George, however, said he first saw the documents last week.

"They were not provided during our audit, even though similar documents that list 'tea party' but not 'progressive' were," George said. "I am very disturbed that these documents were not provided to our auditors at the outset, and we are currently reviewing this issue."

George also noted that IRS officials publicly agreed with his findings that the targeting focused on tea party groups.

"IRS staff at multiple levels concurred with our analysis citing 'tea party,' 'patriot' and '9/12' and certain policy positions as the criteria the IRS used to select potential political cases," George said.

The IRS did not respond to a request for comment.

The IRS was screening the groups' applications because agents were trying to determine their level of political activity. IRS regulations say tax-exempt social welfare organizations may engage in some political activity, but the activity may not be their primary mission. It is up to the IRS to make that determination.

George's report said applications from 298 groups were set aside for special scrutiny. Of those applications, 72 included the term "tea party," 13 included "patriots" and 11 included "9/12," the report said. No other labels were listed in the May report.

On Thursday, George said three groups had the word "progressive" in their name and four used the word "progress."
